Gov. Rick Snyder Signs Six Month Emergency Rule Plan and Application Process for MMFLA

Effective December 4, 2017, Michigan’s Dept. of Licensing and Regulatory Affairs (LARA) have issued a six month emergency rule set for the implementation and enforcement of the State’s Medical Marihuana Facilities Licensing Act (MMFLA). The rules were signed and submitted to Michigan’s Secretary of State by Governor Rick Snyder on Monday and will remain in effect until May, 2018.

The emergency administrative rules are designed to preserve patient protections and provide them with access to safe medical marihuana,

says Andrew Brisbo, Director of the Bureau of Medical Marihuana Regulation (BMMR).

 
The official LARA application process has been announced in the outline of the document and is comprised of three separate rules:

  • Pre-Screening Application Requirements (Financial/Criminal Background)
  • State Operating License & Completed Application (Business Plan, Zoning, Inspection)
  • Application Fees & Assessment ($6,000+)
  • Applicants must also file and provide proof of financial responsibility and insurance for no less than $100,000. Capitalization requirements vary by license type and are as follows:

  • Grower: Class A – $150,000.00
  • Grower: Class B – $300,000.00
  • Grower: Class C – $500,000.00
  • Processor: $300,000.00
  • Provisioning Center: $300,000.00
  • Secure Transporter: $200,000.00
  • Safety Compliance Facility: $200,000.00
